Terms of Service

Welcome to Best GIF Wins (“the Game”), operated by Loomo Labs LLC (“we,” “us,” “our”). By playing the Game, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Game.

1. Eligibility & Accounts

• You must be at least 13 years old (or older if required by your local laws) to play.
• You are responsible for maintaining the security of your account and profile.
• Usernames must follow community guidelines.

2. Third-Party Sources

The Game integrates with GIPHY to supply GIFs. By using these features, you also agree to comply with their platform’s terms. We are not responsible for third-party content.

3. Gameplay & Points

• Points, leaderboards, and badges are virtual items with no cash value and may be reset or changed at any time.
• AI outcomes may be imperfect, reflect automated judgment, and are final and non-appealable.
• Cheating, exploiting, or interfering with gameplay may result in suspension or ban.

4. Payments

If we offer subscriptions, in-app purchases, or premium features, platform store terms (Apple App Store, Google Play) apply. Payments are non-refundable except where required by law.

5. Intellectual Property

Loomo Labs LLC owns the Game, including all software, design, trademarks, and assets.

6. Termination

• We may suspend or terminate your access at any time for violation of these Terms or community guidelines.
• We may also suspend or terminate accounts to comply with legal requirements or platform policies.
• You may stop using the Game at any time.

7. Disclaimers

The Game is provided “as is” and “as available.” We do not guarantee uninterrupted service or error-free operation. To the fullest extent permitted by law, our liability is limited to the amount you paid (if any) in the last 12 months, and we are not liable for indirect or consequential damages.

8. Dispute Resolution

These Terms are governed by the laws of the state where Loomo Labs LLC is formed. Any disputes will be resolved by binding arbitration on an individual basis under a recognized arbitration provider’s rules. Some jurisdictions do not allow arbitration or liability limits; if so, those provisions may not apply to you.

9. Changes to Terms

We may update these Terms from time to time. The updated Terms will include a new Effective Date. Continued use of the Game after changes means you accept the new Terms.
